What A Small Company Can Do Before Taking A Larger Company To Court Over An Unsettled Account
For a small company that has been waiting for a larger company to settle an invoice for work completed, or products delivered, Debt collection by taking the case to court will be a serious step and one which could destroy the professional relationship between the small company and the large company. This relationship could have been built up over a long period but in the current recession, many firms could have suffered with cash flow issues and could want to contact each other before such a serious step of court action is taken.
Before going along this Debt collection strategy, the small company would be best advised to firstly consult the contract for work or supply of products to the large company and see if there is a late payment clause present. If so then they should still contact the large company even if it is only to be told why the payment is late. If the small company has done a lot of work or supplied many products over the years to the large company and this is the first time a payment has been late it is only courteous to enquire if there is a problem. It could be that there has been a simple mistake on the part of the large company that can soon be put right and payment made.
If on the other hand the communication with the large company proves unsatisfactory then the small company could want to commence Debt collection proceedings and if a court case is then the small company needs to be aware that the court officials will need to see amassing confirmation of the Debt collection activity a good strategy would be to obtain Debt collection software, which should be able to use a database in which to store records of the key actions in the Debt collection activity. The Debt collection software should also cover the generating of Debt collection letters in some depth, in particular from the legal aspect so that if the Debt collection letters are produced in court, they should be acceptable. Debt collection letters will form the heart of the Debt collection activity and so must be generated carefully, referring to any paragraphs in the contract that are relevant and of course, the Debt collection letters must be generated in professional and unemotional terms, otherwise they could well put the small company in a bad light in the eyes of the large company. The Debt collection software should have a instructions covering the generating of Debt collection letters so that the small company feels that they have got a good Debt collection software package.
The Debt collection software should have the facility to log key actions in the Debt collection activity such as the generating and sending of Debt collection letters, incoming letters and emails, and a log of phone calls. All of these actions should be date and time stamped for traceability and the Debt collection software should be able to produce a formalised report of the sequence of actions. It would be hoped that the Debt collection letters would have the wished for effect and encourage the large company to pay the invoice and so end the Debt collection activity, rather that it finishing up in court, where the costs could mount up.
